DraftKings Tax Surcharge Explained

In its Q2 2024 earnings call, DraftKings announced plans to assess a “gambling tax surcharge” on customers’ net winnings in four states that tax licensed sportsbook operators 20% or higher: Pennsylvania, New York, Illinois, and Vermont.

The surcharge was slated to take effect on January 1^st, 2025, but DraftKings quickly reversed course and scrapped the plan entirely in the face of overwhelmingly negative customer feedback.

Previously, DraftKings CEO Jason Robins explained that the surcharge was necessary for the company to generate a profit, maintain a high-quality platform, and compete with unlicensed offshore sportsbooks in high-tax states.
